Candidate AI Notice

Certain HackerRank features used by our customers within candidate assessments, tests, screening, upskilling, or interviews make use of artificial intelligence, machine learning, or similar technologies (“AI Features”). This AI Notice explains how AI Features may be used and your related rights when you participate in an AI Feature.

Consent

By proceeding with your participation in an AI Feature, you acknowledge that you have read this Notice and understand that AI may be used as described below.  Your use of an AI Feature is also subject to any separate consents you may have provided to the HackerRank customer inviting you to use the AI Feature (the “Employer”).

How AI May Be Used

Employers may use AI Features to:

  • Evaluate participation integrity: AI Features may analyze your coding, behavioral signals, webcam images, and screen activity to detect anomalies, impersonation, unauthorized uses, and other assessment, test, or interview integrity issues.
  • Evaluate your performance: AI Features may be used to evaluate your performance and/or assess factors such as coding ability, problem-solving skills, technical knowledge, communication skills, work patterns, time management, and adherence to rules.
  • Verify your identity: AI Features may use facial detection technology to compare images taken during the course of your assessment to each other or to compare images from your assessment to images from your interview to confirm you are the same and only person participating. These AI Features are not intended to uniquely identify you, but rather to detect matching or anomalies in the images captured.
  • Conduct autonomous evaluation tasks: AI Features may conduct autonomous interviews, ask follow-up questions, and evaluate your responses using scoring criteria.
  • Assist you during assessments: AI Features (similar to coding assistants like GitHub Copilot) may be available to help you write code, answer questions, and solve problems during assessments, tests, or interviews.

What AI Evaluates

When used for the purpose of evaluation, AI Features may assess technical skills, coding and developer skills, problem-solving ability, communication, work patterns, adherence to rules, fitness for a position, and AI fluency (how effectively you use AI tools).

Your Rights

When an Employer uses an AI Features, depending on your location, you may have the right to do the following with respect to the Employer:

  • Request an alternative selection process or reasonable accommodation if you have concerns about AI-based evaluation or require an accommodation due to a disability;
  • Request human review of decisions made or substantially assisted by AI;
  • Correct inaccurate personal information used in AI-based decisions; and/or
  • Receive an explanation of how AI was used if an adverse decision is made about you.

Additional rights may apply under local laws applicable to you, including the right to opt out of the use of certain AI Features uses or to receive additional information about the use of AI Features.

Image Detection

HackerRank does not consider that its image detecting or matching AI Features process “biometric information” or “biometric data” as defined by applicable law because the features do not use the features to uniquely identify you.  However, if for any reason, an AI Feature is deemed to process biometric information or biometric data (collectively referred to as “biometric information”), then the following will apply:

a. Biometric Information Collection and Use. AI Features may collect and process  information derived from your facial geometry, facial images, voiceprints, or other biological characteristics that can be used to identify you.

b. When collected. The information is collected when you participate in assessment or interview AI Feature that uses image detection, proctoring, identity matching, or impersonation detection features that uniquely identify you.  Collection occurs only when you enable your webcam or participate in features requiring biometric information analysis.

c. Purposes. The information is used to detect impersonation, verify that the candidate participating in an assessment matches the candidate participating in an interview, monitor test integrity through facial detection and behavioral analysis, and match your identity across hiring stages (e.g., screening to interview).

d. Retention. The information will be permanently deleted when the purpose for collection is satisfied (typically determined by the Employer), within three (3) years of your last interaction with HackerRank, or as required by law, whichever occurs first.

e. Disclosure. HackerRank will not sell, lease, trade, or profit from your information. It will be disclosed only to: (1) the Employer; (2) service providers assisting HackerRank under strict confidentiality obligations; (3) when you provide separate consent; or (4) as required by law.

f. Your Consent. If HackerRank collects any biometric information, it will obtain your separate, informed written consent.  You may decline consent, but this may prevent participation in assessments requiring biometric verification. In some jurisdictions, you may withdraw consent by contacting the Employer, though withdrawal may affect your ability to complete the assessment.

g. Your Rights. If HackerRank collects any biometric information, based on your location, you may have the right to access, correct, or request deletion of your biometric information.

h. Data Security and Policies. HackerRank maintains reasonable security measures to protect all information, including any information that is deemed biometric information, including encryption in transit and at rest.
